You agree to provide us with complete, updated and accurate information as we will use these to process your order and/or contact you regarding your purchase or use of the Website.

5. infringe a copyright/trademark/intellectual property rights

PRODUCT

•  All products found on the Website are subject to availability. Given the perishable nature and seasonal availability of fresh flowers, Popular Florists may encounter supply difficulties. In such cases, we reserve the right to substitute a product of equivalent value and quality (or higher value and quality) without notice.
• The photos of floral designs shown on our website are for representations only. All floral arrangements are made by hand so it will be impossible for two creations to be made exactly alike.  We will always strive to re-create the “look and feel” of a chosen arrangement by considering the types of flowers, shape, size, style, color, and floral combinations.
•  In the event that Popular Florists cannot make a substitute or unable to supply the product, we shall notify you as soon as possible and shall issue a replacement or refund.
•  To ensure longer shelf life, certain flower products will be delivered in bud form.
•  Some flower varieties or plants may be harmful to humans and toxic to pets.  If you need further information about the flowers we use, please Contact Us before submitting an order.

• The price of each product is shown on our Website.
• All prices, discounts and promotions posted on the Website are subject to change without notice.
• Posted prices do not include charges for shipping and handling, unless otherwise stated.
• The Website shall detail every fee that needs to be paid at the checkout, before you enter your payment details.
• We strive to display accurate price information but we may, on occasion, inadvertently make typographical errors or inaccuracies related to product availability and pricing. Popular Florists reserves the right to correct any errors or inaccuracies at any time and cancel orders arising from these incidents.

• By placing an order, you are consenting to be bound by the terms and conditions contained in this page.  Submitting an order, however, is still subject to our acceptance. We will send you a confirmation email with your order number and order details. The Order Confirmation email also serves as a tax invoice.
• We accept payment by credit card (VISA, MasterCard, American Express) and PayPal.  Flora Mamma requires the payment of a reasonable surcharge fee for credit card and Paypal payments. These surcharges are also detailed during the order and payment process.

• Because we offer same day delivery, we process orders as soon as we receive them. As such, cancellation requests cannot be accommodated all the time. If there is a need to cancel an order, we expect our customers to do so within a reasonable timeframe. Popular Florists reserves the right to grant or refuse requests of order cancellation.

• Popular Florists delivers fresh flowers throughout Europe.  The delivery fee will depend on the exact delivery address. 
• We deliver to both residential and business addresses. Unfortunately, we are unable to specify a time for delivery. For deliveries to business/commercial addresses, Popular Florists strives to deliver within business hours, usually until 5:00 PM. Flower deliveries to private/residential addresses are until 6:00 PM.
• Deliveries to addresses outside our usual delivery areas may incur additional costs and may be delivered after the aforementioned timeframe. Deliveries during peak season or special occasions such as Valentine’s Day, Mother’s Day and Christmas may also be subjected to extra delivery costs and may be delivered beyond 6PM.
• Orders received after 5:00PM of a Friday will be delivered the following Monday.
• Popular Florists offers same day delivery provided that orders have been received and confirmed before 1:00PM.  Same day deliveries to rural areas, however, cannot be guaranteed. Flower orders that cannot be delivered same day will be delivered on the next business day.
• Extra delivery charges may be applied to re-deliveries due to circumstances beyond our control (wrong/incomplete address, security risk of leaving flowers in front porch/door). Popular Florists reserves the right to refuse re-delivery arrangements due to incorrect or incomplete delivery information supplied by the Customer.
• Once the order has been delivered, the recipient will be responsible for the proper care and vase life expectancy of the delivered flowers.

• By entering the Website, you agree to be bound by Popular Florists Terms & Conditions. We cannot be held liable for loss suffered through failure to comply with our terms and conditions.
• We cannot be held liable for any loss suffered through improper/incorrect use of our products and our website.
• Popular Florists shall have no liability for product damage, delivery delays or any failure to deliver products you have ordered if caused by circumstances outside our control (i.e. strikes, lockouts, civil commotion, flood, fire, explosion, war, acts of God).
• Under no circumstances will Popular Florists be liable to you for any direct or indirect loss, expense, or damages of any kind arising from any defect, error, or inaccuracy with the Website, its contents or associated services, or due to any unavailability of any part of the Website as a result of any computer virus.

Popular Florists reserves the right to supplement, amend or make changes to these Terms at any time. The changes are effective immediately after the posting of the updated Terms & Conditions.

• This website is controlled and operated by Popular Florists. The formation, existence and validity in all aspects of these terms and conditions shall be governed by European law. The European courts shall have exclusive jurisdiction to settle any disputes arising out of or in connection with these Terms and Conditions.
